Please read these Terms of Service carefully before installing or using Surreal POS. By using the App, you agree to be bound by these terms.
These Terms of Service ("Terms") constitute a legally binding
agreement between you ("User", "you", or "your") and
Source Gambit ("Company", "we", "us", or "our"), the
developer of Surreal POS (the "App"), available on
Android and iOS under the identifier

By downloading, installing, accessing, or using the App, you confirm that:

Surreal POS is a point-of-sale application designed to help businesses manage sales transactions, inventory, customers, and financial reports. The App includes features such as:
The App is designed to operate primarily offline. Certain features (such as license verification) require an internet connection.
Subject to your compliance with these Terms, Source Gambit grants you a limited, non-exclusive, non-transferable, revocable licence to download and use the App on devices you own or control, solely for your personal or internal business purposes.
You agree to use the App only for lawful purposes and in accordance with these Terms. You must not use the App:
We reserve the right to suspend or terminate your access to the App if we determine, in our sole discretion, that you have violated these acceptable use requirements.
Surreal POS offers a free tier with access to core features. We reserve the right to modify what features are included in the free tier at any time with reasonable notice.
Premium features may require purchase of a licence. All purchases are subject to the following conditions:
Refund requests are handled by the respective app store (Google Play or Apple App Store) in accordance with their refund policies. We do not process refunds directly. If you believe you are entitled to a refund, please contact the store from which you made the purchase.
We are not responsible for payment disputes or refunds processed by third-party stores. Please review the Google Play refund policy and Apple App Store refund policy before making a purchase.
The App, including all content, features, functionality, design, code, trademarks, logos, and trade names, is owned by Source Gambit and is protected by copyright, trademark, and other intellectual property laws.
The "Surreal POS" name and logo are trademarks of Source Gambit. You may not use these marks without our prior written permission.
Nothing in these Terms transfers any intellectual property rights to you. Your only rights in the App are those expressly granted in Section 3 above.
You retain full ownership of all data you enter into the App, including product information, customer records, sales transactions, and business settings ("Your Data").
Since the App is offline-first, Your Data is stored locally on your device. You are responsible for:
Source Gambit is not liable for any loss of Your Data due to device failure, accidental deletion, or any other cause outside our reasonable control.
We strongly recommend using your device's backup features (iCloud, Google Backup) to protect your business data.
The App is provided on an "AS IS" and "AS AVAILABLE" basis, without any warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, title, or non-infringement.
We do not warrant that:
Some jurisdictions do not allow the exclusion of implied warranties. In such jurisdictions, the above exclusions apply to the fullest extent permitted by law.
To the maximum extent permitted by applicable law, Source Gambit and its officers, directors, employees, and agents shall not be liable for any:
In any case, our total liability to you for all claims shall not exceed the amount you paid to us (if any) in the twelve (12) months preceding the claim.
Surreal POS is a tool to assist your business operations. It is not a substitute for qualified accountancy, tax, or legal advice. Always verify financial data and consult a qualified professional for tax and compliance matters.
You agree to defend, indemnify, and hold harmless Source Gambit and its officers, directors, employees, contractors, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including attorneys' fees) arising out of or relating to:
We may release updates to the App from time to time to add features, fix bugs, or improve performance. We recommend keeping the App updated to the latest version to benefit from security patches and new features.
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the "Last updated" date and displaying a notice within the App. Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms.
We may suspend or terminate your access to the App at any time, with or without notice, if:
You may stop using the App at any time by uninstalling it. Upon termination, your licence to use the App ceases immediately. Provisions that by their nature should survive termination (including intellectual property rights, disclaimers, limitations of liability, and indemnification) will survive.
These Terms are governed by and construed in accordance with applicable law in the jurisdiction where Source Gambit is registered. Any disputes arising under or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation.
If a dispute cannot be resolved through negotiation within 30 days, it shall be submitted to binding arbitration or the competent courts of the governing jurisdiction, as agreed between the parties or as required by applicable law.
Nothing in this section prevents you from raising a complaint with your local consumer protection authority.
